Terms of Service

Welcome to IChingGuide ("the Platform"). Please read these Terms of Service carefully. By accessing or using the Platform, you agree to be bound by these terms. If you do not agree, please do not use our services.

1. Nature of Services

The Platform provides BaZi analysis, Feng Shui consultation, compatibility analysis, name analysis, and related services rooted in classical Chinese philosophical and cultural traditions. These are cultural consultation services.

All consultation content represents the practitioner's personal interpretation and analysis based on traditional scholarly frameworks. It does not constitute medical advice, legal advice, financial or investment advice, or psychological counseling. Consultation outputs are offered for reference only and carry no guarantee or warranty of any kind.

If you are facing significant medical, legal, or financial matters, please consult a licensed professional.

2. User Eligibility

By using the Platform, you represent and warrant that:

  • You are at least 18 years of age and have full legal capacity;
  • The registration information you provide is true, accurate, and complete;
  • You are using the Platform for personal, non-commercial purposes;
  • You comply with all applicable laws and regulations in your jurisdiction.

The Platform reserves the right to suspend or terminate accounts where there is reasonable suspicion of a breach of these representations.

3. Account Responsibility

You are responsible for all activities that occur under your account. Please keep your login credentials secure. If you discover unauthorized use of your account, notify us immediately at yishao.zhang2026@gmail.com.

The Platform is not liable for any losses resulting from your failure to safeguard your account credentials.

4. Booking and Service Delivery

Booking: To book a consultation, you must provide accurate birth information (year, month, day, and hour) at the time of booking. Inaccurate information may affect the quality of analysis; the Platform is not liable for analytical variations arising from information you provide.

Delivery: Consultation services are delivered via video call (WeChat, Zoom, or Tencent Meeting). Course content is delivered through the Platform's designated channels.

Time zone: Consultation times are based on Beijing Time (UTC+8). The booking system displays local time zone equivalents for your convenience.

Cancellation and rescheduling: Please notify us at least 24 hours before your scheduled session via the Platform or by contacting us directly.

5. Refund Policy

One-on-One Consultation Services:

  • Cancellation more than 24 hours before the session: Full refund, no fee.
  • Cancellation less than 24 hours before the session: 50% refund.
  • Cancellation after the session has begun: No refund (the practitioner's time has been committed).
  • Session cancelled due to Platform technical failure or practitioner cancellation: Full refund, with priority rescheduling offered.

Course Products:

  • Cancellation after payment but before the course begins: Full refund.
  • Cancellation after the course has started (up to 25% completed): 75% refund.
  • Cancellation after more than 25% of the course is completed: No refund, but you may apply to defer or transfer your enrollment (subject to Platform approval).
  • Downloaded or accessed digital content: No refund (please review course details carefully before purchasing).

EU Residents — Digital Content (Important Notice): Under the EU Consumer Rights Directive (2011/83/EU), EU residents have a 14-day right of withdrawal from digital course purchases. This right is waived if you explicitly request immediate access to course content at checkout (Directive Art. 16(m)). By selecting immediate access, course materials are unlocked upon payment confirmation and the cooling-off period no longer applies. One-on-one consultations are personalised services (Directive Art. 16(c)) and are exempt from the 14-day cooling-off period once confirmed.

Refund Process: Send your refund request to yishao.zhang2026@gmail.com with your order details. Approved refunds will be returned to your original payment method within 7–14 business days.

6. Intellectual Property

All content on the Platform — including but not limited to articles, course materials, images, and brand assets — is protected by copyright and owned by the Platform or its licensors.

Without written authorization, you may not reproduce, distribute, modify, display, or otherwise use such content. Personal study and non-commercial citation are permitted with appropriate attribution.

7. User Conduct

By using the Platform, you agree not to:

  • Provide false information to deceive the Platform or other users;
  • Attack, disrupt, or interfere with Platform systems;
  • Use the Platform for illegal, fraudulent, or harassing activities;
  • Scrape or commercially reproduce Platform content;
  • Impersonate Platform staff or practitioners.

Violations will result in immediate account termination and may give rise to legal liability.

8. Third-Party Practitioners

Where the Platform opens to third-party practitioners, the Platform operates as an information intermediary and makes no guarantee regarding the consultation content, analytical accuracy, or service quality of any third-party practitioner. Third-party practitioners provide services independently; the Platform does not assume joint liability for their consultation outputs.

In the event of a dispute between a user and a third-party practitioner, the Platform will provide reasonable coordination assistance but does not assume arbitration or indemnification obligations.

9. Limitation of Liability

To the fullest extent permitted by applicable law:

  • The Platform makes no warranty as to the accuracy, completeness, or fitness for purpose of any consultation service;
  • The Platform is not liable for indirect losses, lost profits, or lost opportunities arising from use of or inability to use the Platform;
  • The Platform's maximum liability to any individual user shall not exceed the total amount that user has paid to the Platform in the 12 months preceding the relevant event.

10. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Singapore, except where mandatory consumer protection provisions of your local jurisdiction apply.

Step 1 — Informal Resolution (Required): Before initiating any formal proceedings, the disputing party must notify the other in writing (by email) describing the dispute and the relief sought, and allow 30 days for good-faith resolution.

Step 2 — Mediation (Optional): If informal resolution fails, the parties may voluntarily submit the dispute to the Singapore Mediation Centre (SMC) or another mutually agreed mediator.

Step 3 — Arbitration: Unresolved disputes shall be submitted to the Singapore International Arbitration Centre (SIAC), with Singapore as the seat, governed by SIAC Rules, with the language of arbitration to be agreed between the parties. The arbitral award shall be final and binding.

Consumer Rights Carve-Out: The above dispute resolution mechanism does not affect any mandatory consumer protection rights you may have under local law, including:
- EU/UK consumers may bring proceedings before a court in their place of residence, or use the EU ODR platform (ec.europa.eu/consumers/odr)
- Australian consumers may seek relief under the Australian Consumer Law (ACL)
- Consumers in other jurisdictions retain their mandatory local consumer rights, which these Terms do not exclude

11. Amendments

The Platform reserves the right to amend these Terms at any time. Material changes will be communicated via site announcement or email at least 15 days before taking effect. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
